Terms of Service

The rules and conditions for using Home Service Content’s website, magic links, and subscription content services.

1. Agreement and Acceptance

These Terms of Service ("Terms") govern your access to and use of the services provided by Home Service Content ( "Company", "we", "us" , "our"), including our website, magic link previews, subscription content services, client portal, and any related tools or documentation (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent and warrant that you have authority to bind that business, and "you" refers to that business.

2. Eligibility and Business Use

The Service is intended for business users in the home services and related sectors. You must be at least the age of majority in your jurisdiction and have the legal capacity to enter into a binding contract. You agree to use the Service only for lawful business purposes and in compliance with these Terms and applicable laws.

3. Accounts and Access

Certain features of the Service may require you to create an account or access a secure portal. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to notify us promptly of any unauthorized access or use.

We reserve the right to suspend or terminate access to the Service if we reasonably believe you have violated these Terms or applicable law.

4. Description of the Service

The Service provides done-for-you content creation for local home-service businesses. When you subscribe, you receive content packs that typically include locally focused articles, supporting resources, and related assets such as meta descriptions and publishing guidance tailored to your services and service area.

We may also provide access to a client portal and personalized magic links so you can review, download, and request revisions to your content and see certain engagement and billing information related to your subscription.

We may update or modify the Service from time to time, including by adding or removing features. If a change materially reduces core functionality for active subscribers, we will use reasonable efforts to provide notice.

5. Subscriptions, Billing, and Refunds

The Service is typically offered on a subscription basis (for example, monthly content packs). Pricing, billing period, and plan details are presented at checkout or in your account.

  • Payments: Payments are processed by Stripe or another payment processor we designate. By subscribing, you authorize us and our processor to charge your selected payment method for recurring subscription fees, applicable taxes, and any additional charges you approve.
  • Auto-Renewal: Unless otherwise specified, subscriptions renew automatically at the end of each billing period until cancelled.
  • Price Changes: We may adjust pricing or plan features over time. Any price change will apply only to subsequent billing periods, and we will provide advance notice where required.
  • Refunds: Unless otherwise stated or required by law, fees are non-refundable, including for partial billing periods, unused content, or downgrades. We may issue credits or refunds at our discretion in exceptional cases.

6. Revisions and Usage Limits

Some subscription plans include a limited number of content revision requests per billing cycle. We track revision usage and may decline requests that:

  • Exceed your plan's revision limits.
  • Are abusive, repetitive, or outside the scope of the Service (for example, entirely new topics unrelated to the original request).

7. Content Ownership and Licenses

7.1 Your Content and Brand

You retain ownership of your trademarks, logos, brand assets, and any content or data you provide to us. You grant us a non-exclusive, worldwide license to use this material solely as necessary to provide and improve the Service.

7.2 Generated Content

Subject to your payment of applicable fees, we grant you a non-exclusive, perpetual, worldwide license to use, reproduce, modify, and distribute the content we generate for you (including content plans and articles) for your own business purposes and, where applicable, to serve your clients, unless otherwise agreed in writing.

We may retain copies of generated content for backup, quality assurance, analytics, and internal training, and we may use anonymized examples or excerpts in demos or documentation, unless you and we agree otherwise.

7.3 Our Platform

We and our licensors retain all rights, title, and interest in and to the Service itself, including underlying software, templates, prompts, scoring models, style guides, algorithms, and operational processes. These are not sold to you, and you receive only a limited right to access and use the Service in accordance with these Terms.

8. Use of AI and Third-Party Services

The Service uses third-party providers, including AI and video tools, to deliver certain features. For example:

  • AI/LLM providers to generate or refine content.
  • Discovery tools to identify and analyze prospects.
  • Video generation services to create personalized explainer videos.
  • Payment processors, email providers, and hosting infrastructure.

When you use the Service, information about your business and content needs may be included in prompts or payloads sent to these providers as reasonably necessary to operate the Service. We select providers we believe take appropriate measures to protect data, but we do not control their independent terms or policies.

9. Acceptable Use

You agree not to:

  • Use the Service in any way that violates applicable law, including privacy, consumer protection, and anti-spam laws.
  • Use the Service to generate or distribute content that is unlawful, harassing, hateful, or misleading.
  • Use generated content as professional legal, medical, financial, or other regulated advice without appropriate professional review.
  • Attempt to reverse engineer, decompile, or otherwise access the Service's source code, except to the extent permitted by applicable law.
  • Interfere with or disrupt the Service or its infrastructure.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee specific search rankings, traffic levels, lead volume, or other business results. Content is generated with the assistance of AI models and may contain inaccuracies or omissions. You are responsible for reviewing and approving content before publication.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, goodwill, or data, arising out of or related to the Service or these Terms.

Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to us for the Service in the three (3) months preceding the event giving rise to the claim, and (b) CAD $250, unless a higher amount is required by applicable law.

12. Indemnity

You agree to indemnify and hold us harmless from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your publication or distribution of generated content; or (c) your violation of these Terms or applicable law.

13. Termination

You may cancel your subscription in accordance with the instructions in your account or as otherwise provided by us. We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if providing the Service is no longer commercially or technically feasible.

Upon termination, your right to access the Service ends, but any rights you already have to use delivered content typically remain subject to these Terms and any unpaid amounts.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where Home Service Content is headquartered, without regard to conflict-of-laws principles. At the time of publication, that jurisdiction is Calgary, Alberta. You agree that any disputes arising out of or relating to these Terms or the Service will be submitted to the courts located in that jurisdiction, and you consent to their authority, except where mandatory law in your own jurisdiction (for example, certain U.S. state or federal consumer protection laws) gives you additional rights.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and may provide additional notice, such as via email or in-app messaging. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
